At Headway Construction Ltd. (“Headway Construction,” “we,” “us,” or “our“), protecting your privacy and personal information is important to us. This notice applies to consumers in Nova Scotia and elsewhere in Canada. It is intended to support compliance with Canada’s Anti-Spam Legislation (CASL), applicable privacy laws, and carrier requirements for SMS programs. It does not replace legal advice. We may update this policy when our practices, services, vendors, or legal obligations change.

Address: 751C Herring Cove Road, Halifax, Nova Scotia, B3R 1Y9
Privacy contact: Privacy Officer
Email: contact@headwayconstruction.ca

2. Personal information we collect
Depending on how you interact with us, we may collect the following information:
- Personal identifiers: your name, email address, telephone number, mobile telephone number, mailing or project address, and other contact details you provide through contact forms, quote requests, email, or telephone conversations.
- Project and service information: details about your construction project, service requests, preferences, feedback, communications, and information needed to provide or manage our services.
- Transaction information: information needed to process payments and maintain transaction and business records.
- Technical information: your IP address, browser type, device information, browsing activity, and similar data collected through cookies and related technologies.
- SMS information: if you subscribe to our SMS Program, we collect your mobile number, the date and time of your opt-in, the source and method of your opt-in, the disclosure shown to you at opt-in, messages sent or received, delivery information, and records of opt-out, help, or support requests.
We do not intentionally collect sensitive personal information through SMS. Please do not send passwords, payment-card numbers, government identification numbers, health information, or other sensitive information by text message.
3. How we collect information
We collect information directly from you when you submit a website form, request a quote, contact us by telephone or email, communicate with us about a project, use our services, or otherwise interact with Headway Construction.
We also collect limited technical information automatically when you visit our website through cookies and similar tracking technologies. This information helps us operate the website, improve functionality, understand visitor behaviour, analyse performance, and protect against fraud or unauthorized activity.
We do not purchase or use third-party lists for our SMS Program unless we can verify that the applicable person provided valid consent to receive messages from Headway Construction for the stated purpose.
4. How we use personal information
We use personal information only for purposes that a reasonable person would consider appropriate in the circumstances and that we identify when we collect it. These purposes include:
- responding to inquiries and providing estimates or quotes;
- delivering and managing construction services, including project follow-ups and customer support;
- processing payments and maintaining transaction records;
- sending service, appointment, project, account, or security messages that you request or that are otherwise permitted by law;
- sending information about our services, promotions, and updates when we have the consent required by law;
- sending SMS messages when you have provided the required consent;
- operating, maintaining, improving, and securing our website and services;
- preventing fraud, abuse, and unauthorized activity;
- maintaining business, consent, and suppression records; and
- meeting legal, regulatory, contractual, and dispute-resolution obligations.
We will not use your mobile number for a materially different purpose from the purpose disclosed at collection without providing any notice or obtaining any consent required by law.
5. SMS Messaging Program
Our SMS messaging program is operated using RingCentral. The program may send appointment reminders, service updates, account notices, project-related communications, and promotional offers to the mobile number you provide. Message frequency varies based on your interactions with us and the services or information you request. Message and data rates may apply according to your mobile plan. Carriers are not liable for delayed or undelivered messages.
How we obtain consent
We obtain express SMS consent through a clear, affirmative action, such as an unchecked checkbox, a website form, a keyword texted to our number, or another method that records your agreement. We do not treat silence, an existing telephone number, or a pre-checked box as consent. Consent to receive marketing SMS is not a condition of purchasing goods or services.
At the time of opt-in, we identify Headway Construction, describe the messages you will receive, explain that message frequency varies, disclose that message and data rates may apply, provide instructions for obtaining help and stopping messages, and link to this Privacy Policy. We retain evidence of the consent and the disclosure presented at the time of opt-in.
How to stop messages
You may stop recurring SMS messages at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to the number from which you received the message. After receiving a valid opt-out request, we may send one final message confirming that you have been unsubscribed. We will not send further recurring marketing SMS unless you provide new express consent.
You may also opt out by contacting contact@headwayconstruction.ca or 902-480-4474. We process opt-out requests promptly and maintain suppression records so that a number that has opted out is not re-added to a marketing list without new consent.
How to get help
For help with the SMS Program, reply HELP or contact contact@headwayconstruction.ca or 902-480-4474. For privacy questions, contact our Privacy Officer at contact@headwayconstruction.ca.
Opting out of promotional SMS does not necessarily stop non-promotional service or transaction messages that are necessary to provide a service you requested. You may contact us to ask about available communication preferences. You do not need to provide personal information by text message in order to unsubscribe.
6. SMS opt-in disclosure
The SMS opt-in checkbox on our website should be unchecked by default and should remain separate from any general terms or marketing consent. The disclosure should read substantially as follows:
By checking this box and submitting this form, I agree to receive recurring SMS messages from Headway Construction Ltd. at the mobile number provided. Messages may include appointment reminders, service updates, account notices, project-related communications, and promotional offers. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to unsubscribe and HELP for help. I have read the Privacy Policy.
We retain the version of this disclosure, the page or form where it appeared, the date and time of opt-in, the mobile number, the opt-in source or keyword, and any later opt-out event.
7. When we disclose personal information
We do not sell, trade, or rent your personal information to third parties. We may share personal information with service providers that help us operate our business, such as payment processors, website hosting providers, customer-support providers, communications providers, analytics providers, security providers, and consent or suppression-list managers. These providers may access information only as needed to perform services for us and must protect it under contractual or other appropriate safeguards.
We may also disclose information when required or permitted by law, in response to a valid legal request such as a subpoena or court order, to protect our rights or property, to investigate fraud or security incidents, to protect a person’s safety, or in connection with a merger, financing, reorganization, sale of assets, or similar business transaction, subject to appropriate protections.
Mobile numbers and SMS opt-in data are not shared or sold to third parties for their own marketing purposes. We do not use SMS consent obtained for Headway Construction to promote unrelated third-party products or services.
8. Service providers and information outside Nova Scotia or Canada
Some service providers may process or store information outside Nova Scotia or Canada. The SMS Program is provided through RingCentral. When information is transferred to another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement authorities, or regulators there. We use contractual, technical, and organizational safeguards appropriate to the sensitivity and purpose of the information.
9. Cookies and tracking technologies
Our website may use cookies, pixels, logs, analytics tools, and similar technologies to operate the website, remember preferences, understand browsing activity, improve performance, and help protect against fraud. You can manage or disable cookies through your browser settings. Disabling cookies may affect the functionality of certain website features.
10. Retention and deletion
We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this policy, provide and administer services, maintain accurate business and consent records, resolve disputes, enforce agreements, meet legal and regulatory requirements, and protect our legitimate interests.
Consent and suppression records may be retained after an opt-out so we can demonstrate compliance and prevent unwanted messages. When information is no longer required, we securely delete it, destroy it, or anonymize it, subject to legal, technical, or operational limitations.
11. Security safeguards
We use reasonable physical, technical, and organizational safeguards appropriate to the sensitivity of the information. These safeguards may include encryption, firewalls, secure servers, access controls, staff confidentiality obligations, authentication, logging, vendor controls, secure disposal, and procedures for responding to suspected privacy or security incidents.
No method of transmission or storage is completely secure. Although we take reasonable precautions, we cannot guarantee absolute security.
12. Your privacy rights
Subject to applicable law and reasonable identity verification, you may request access to personal information we hold about you, ask us to correct inaccurate or incomplete information, ask questions about our collection, use, or disclosure practices, and request deletion where applicable. We may need additional information to verify your identity and protect against unauthorized access. If we cannot provide access, make a correction, or delete information, we will explain the reason unless prohibited by law.

If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada where PIPEDA applies. 13. Children
Our website and SMS Program are not directed to children under the age of 18. We do not knowingly collect personal information from a child in violation of applicable law. If you believe a child has provided personal information to us, contact contact@headwayconstruction.ca.
14. Changes to this policy
We may update this Privacy Policy from time to time. Any changes will be posted on this page at headwayconstruction.ca/privacy-policy/, and the effective date will be updated. If a change materially affects the purposes or ways in which we use personal information or SMS consent, we will provide additional notice and obtain consent where required.
